Terms of use

1General

These Terms govern the use of the website tablehint.com and the SaaS platform tablehint.app (together: the “Service”). By using the Service, you confirm that you have read, understood, and accepted these Terms. If you use the Service on behalf of a legal entity, you warrant that you are authorized to bind that entity.

2Description of the Service

Tablehint is a platform for hospitality venues that includes:

• Digital menu for guests available via QR code scan, with no guest registration required, including AI sommelier recommendations;
• Staff application with sign-in, guest pairing, AI assistant for menu and beverage knowledge, and modules for training and an item library;
• Owner/admin panel for managing the menu, users, venue content, and reviewing analytics and reports.

The Provider continuously develops the Service and reserves the right to add, modify, or discontinue specific features.

3User account and responsibility

• The owner/administrator account is created after a contract or individual arrangement with the Provider.
• The owner (Customer) is responsible for the accuracy of data entered into the platform, for managing employee accounts, and for safeguarding access credentials.
• The Customer warrants that it has the right to enter employee and venue data into the platform and to inform them about the processing in accordance with the Privacy Policy.
• The user undertakes to use the Service lawfully, not to abuse it, attempt to bypass security mechanisms, or use it to send spam, malware, or illegal content.

4Customer content

All content the Customer uploads to the platform (menu, descriptions, images, venue branding) remains the Customer’s property. The Customer grants the Provider a non-exclusive license to host, display, and process such content for the purpose of providing the Service. The Customer warrants that it holds all necessary rights to the content it uploads.

5AI features

Tablehint uses AI for guest recommendations and staff support. AI responses are based on the data the Customer enters (menu, descriptions, venue context) and are informational in nature. The Provider does not guarantee the absolute accuracy of AI responses, and human review is recommended before making business decisions. AI processing is performed via vetted AI partners, with limited and, where possible, anonymized context.

6Pricing and payment

• Service pricing is agreed individually between the Provider and the Customer, based on scope and number of locations.
• All prices are stated in EUR, excluding VAT unless stated otherwise.
• Payment terms, setup fees, and the billing period are defined by the individual contract or quote.
• Prices shown on tablehint.com are informational and do not constitute a binding offer.

7Term and termination

• The contract is concluded for the term defined by the individual quote (monthly or annual).
• The Customer may terminate the contract subject to the notice period in the quote (typically 30 days for monthly plans).
• The Provider may temporarily or permanently suspend access in case of breach of Terms, non-payment, or abuse of the Service, with prior notice where reasonably possible.
• Upon termination, the Customer may, within a reasonable period (up to 30 days), request an export of its data before deletion.

8Service availability

The Provider will use reasonable efforts to keep the Service available 24/7 but does not guarantee uninterrupted operation. Temporary interruptions may occur due to maintenance, upgrades, or reasons beyond the Provider’s control (infrastructure provider incidents, force majeure).

9Intellectual property

The entire platform, source code, design, “Tablehint” branding, logos, and documentation are owned by the Provider and protected by copyright. Use of the Service does not transfer any intellectual property rights to the Customer, other than the right of use in accordance with these Terms.

10Limitation of liability

• The Service is provided “as is”, without express or implied warranties beyond what is set out in the contract.
• The Provider is not liable for indirect, consequential, or incidental damages, lost profits, or lost data.
• The Provider’s total liability, regardless of legal basis, is limited to the amount paid by the Customer for the Service in the 12 months preceding the event giving rise to the damage.
• These limitations do not apply where liability cannot be excluded under Croatian law (e.g., intent, gross negligence, death or bodily injury).

11Confidentiality

The parties shall maintain the confidentiality of business information exchanged during the use of the Service and shall not disclose it to third parties without written approval, unless legally required.

12Personal data processing

The processing of personal data is governed by the Privacy Policy. When the Provider processes personal data on behalf of the Customer (e.g., employee or guest data), the parties apply standard contractual data processing terms (DPA), which form part of the individual contract or are available on request.

13Changes to the Terms

The Provider may amend the Terms with prior notice via email or in-platform notification at least 15 days before the changes take effect. Continued use of the Service after the changes take effect is deemed acceptance.

14Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Croatia. The competent court shall be the materially competent court in Zagreb, except where otherwise required by mandatory consumer protection laws.
